On private projects, if the general contractor furnishes an unconditional payment bond to the owner, the bond should be issued pursuant to Florida Statute s. 713.23. The term unconditional means that the general contractor’ payment to subcontractors and suppliers (etc.) is not conditioned on its receipt of payment from the owner. The objection of this unconditional payment bond is to exempt the owner’s property from liens — no matter what.
